RE:
Request that the Board waive the $600 campaign finance late fee assessed against Levi Lewis, Sr., a candidate for Washington Parish Assessor, in the October 22, 2011 election, whose 30-P campaign finance disclosure report was filed 145 days late.
Facts:
In connection with his request for a waiver of the $600 late fee assessed for the late filing of a 30-P campaign finance report, Levi Lewis, Sr., states that his report was filed late due to an oversight. When he became knowledgeable of the oversight, he secured the service of an accountant to assist with the filings of his reports. He maintains that it was his initial understanding that he was required to report financial activities within the first thirty days. He was not aware that he was required to report if there was no financial activity. Mr. Lewis is a district level candidate. This is his first campaign. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.



Recommendations:
In accordance with the waiver guidelines, suspend all but $200 based on future compliance.
