RE:
Request that the Board waive the $480 and $480 campaign finance late fees assessed against Scott Masson, a candidate for State Representative, District 88, in the November 24, 2001 election, and State Representative, District 79 in the October 20, 2007 election, whose two (2) Supplemental campaign finance disclosure reports were each filed 8 days late.
Facts:
In connection with his request for a waiver of the $480 and $480 late fees assessed for the late filings of two (2) Supplemental campaign finance reports, Scott Masson, states that his original supplemental campaign finance report was filed in 2011 showing a zero balance. A representative from the Ethics office helped him over the phone in 2011 to submit the report electronically. He maintains that no further reports were required. However, in 2012 he received notice that another Supplemental report was due. He further states that he contacted the Campaign Finance division to inquire about the notice and was told that there was no record of his electronic report from 2011. Mr. Masson states that he was told to erase the 2011 year on the report and replace with the 2012 year. It is Mr. Masson's belief that he was not required to file a report for the 2012 year. Mr. Masson is a district level candidate. He was an unsuccessful candidate in both November 24, 2001 and October 20, 2007 campaigns.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.
