RE:
Request that the Board waive the $600 campaign finance late fees assessed against Larry Pernell Jones, a candidate for Sheriff of Lincoln Parish, in the October 22, 2011 election, whose 10-G campaign finance disclosure report was filed 91 days late.
Facts:
In connection with his request for a waiver of the $600 late fee assessed for the late filing of a 10-G campaign finance report, Larry Pernell Jones states that he filed his report prior to the November 9, 2011 due date. He further states that he received notice from the Campaign Finance division that his report had not been filed. Upon receipt of notice, he contacted the Campaign Finance division to inform that he had already submitted a report via fax. He was told that a report had not been received and was advised to re-submit his report. In addition, a research of the fax number used by the candidate was made by the IT division. The IT division was unable to find a record of a fax attempt before or during the time that the 10-G report was due. The only fax attempt made was on the date of December 1, 2011, which resulted in error. A copy of the record is attach for reference. Mr. Jones is a district level candidate. This his first campaign. He was an unsuccessful candidate.

A 30-P report filed 13 days late, in connection with the October 22, 2011 election. The candidate is presently making monthly payments of $50.00 toward the assessed $200 late fee. The last payment of $50 was made on May 29, 2012. The amount of $50 remains outstanding.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
