In connection with his request for a waiver of the $1,000 late fee assessed for the late filing of a Special campaign finance report, Mark W. Shumate, states that he misunderstood filing instructions for filing the report. He maintains that it was never his intention to fail to file; as he reported the check in question on a regular Candidate's report, just not on a Candidate's Special report. He further states that he is leaving office June 30, 2012, and ask that the Board reconsider the late fee assessment, as he certainly thought that he was following reporting requirements. Mr. Shumate is a major level candidate. This is his fifth campaign. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
