Request that the Board waive the $420 campaign finance late fee assessed against Willie Jones, Jr., a candidate for State Representative, District 101, in the January 22, 2011 election, whose Supplemental campaign finance disclosure report was filed 7 days late.
Facts:
In connection with his request for a waiver of the $420 late fee assessed for the late filing of a Supplemental campaign finance report, Willie Jones, Jr. states that his campaign treasurer electronically filed his report on February 14, 2012. He then contacted the Campaign Finance division to advise that he did file his report timely and that according to his electronic confirmation number, he was under the impression that the transmission was successful. At that time he was told to re-submit his report as soon as possible. The report was filed on February 22, 2012. Mr. Jones maintains that he contacted Ethics IT division in an attempt to locate his original report transmittal, but to no avail. In addition, staff contacted Mr. Jones on June 21, 2012 to request a copy of his fax transmittal, as referenced in his waiver request. Mr. Jones stated that if he is able to locate his fax transmittal, he will provide a copy of it. Mr. Jones states that he has never been late in filing his reports. Mr. Jones is district level candidate. This is his third campaign. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.
