RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Willard J. Brown, Sr., whose Annual campaign finance disclosure report was filed 435 days late.
Facts:
In connection with his request for a waiver of the $1,000 late fee assessed for the late filing of an Annual campaign finance report, Willard J. Brown, states that he was contacted by the Ethics staff who informed him that he failed to file an Annual report for the calendar year of 2011. Mr. Brown further states that his mother was hospitalized the entire month of January 2011 and her mail was being held by the U. S. Postal office during the entire period. His mother passed away on February 7, 2011. Approximately the second or third week in March of 2011, all of the held mail was delivered, however, there was no correspondence from the LA Board of Ethics. Mr. Brown further states that his campaign fund account had a balance of $210 at the close of the campaign. The money was left in the account, but was absorbed by bank account fees, which subsequently caused the account to be overdrawn. He states that he had to place money into the account to cover overdraft fees, before closing it. Mr. Brown is a major level candidate. This is his second campaign. He was an unsuccessful candidate.

A 10-P and Supplemental campaign finance reports filed 1 and 7 days late, in connection with the October 4, 2008 election. The late fee assessed for the 10-P has been paid. The late assessed for the Supplemental report has not been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
52:1205B(1) provides that the staff of the Board shall rescind an assessed late fee of the candidate where an immediate family member of the person responsible for filing of the reports has died on the date the report was due or seven days prior to the due date of the report (2)or a serious medical condition prevented the responsible report preparer from preparing the reports.



Recommendations:
Rescind the late fee assessed.
