Appearance in connection with a request for reconsideration of a waiver of the $420, $120, and reassessed $4,300 ($4,840 total) campaign finance late fees assessed against Michael Wayne "Mike" Stagg, a candidate for Lafayette Parish President, in the October 22, 2011 election, whose EDE-P and 10-G campaign finance disclosure reports were filed 7 and 2 days late.
Facts:
In connection with his request for a reconsideration of a waiver of the $420, $120, and reassessed $4,300 late fees assessed for the late filings of an EDE-P and 10-G campaign finance reports, Michael Wayne "Mike" Stagg, states that he would like to address the Board regarding his request for a waiver.
In his original waiver request, Mr. Stagg disputed the reassessment of $4,300 in late fees. He stated that his 2003 campaign was organized under a Limited Liability Company, which was created for the sole purpose of conducting the campaign. He further stated that the original registered agent did not have the time to run the campaign, and he personally did not have the resources to pay the agent to remain involved in the campaign. He maintained that all contributions and expenditures from the 2003 campaign were handled through a checking account in the name of the LLC. As for the $420 and $120 late fee assessments, the candidate stated that all funds from his 2011 campaign were reported and the campaign was closed. Mr. Stagg is a district level candidate. This is his second campaign. He was an unsuccessful candidate.

The $1,000 late fee has been paid. The $4,300 was reassessed as a result of the recent late filings of the EDE-P and 10-G report in connection with the October 22, 2011 election.


Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
