Advisory opinion regarding the post employment restrictions on Theresa Willams, an Accountant 4 employed with DNR, after her retirement.
Facts:
Ms. Theresa Williams is currently an Accountant 4 with Department of Natural Resources (DNR). She plans on retiring soon. She has asked if after retirement she can work as a Coastal Resources Program Specialist for Office of Coastal Protection and Restoration Authority (CPRA) as a contract worker, or can she handle accounting matters for CPRA as a contract employee or a wage worker, and finally can she work for CPRA in a job other than accounting. CPRA is part of DNR. Ms. Williams as an Accountant 4 does the accounting for CPRA. The Coastal Resources Program Specialist is not an accounting position.

Law:
1121 B. (1) General rule for other public employees. No former public employee shall, for a period of two years following termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.
