Advisory Opinion request regarding the post employment restrictions on Mr. Scott Jenkins, an "accounts payable" accountant for Fletcher Technical Community College (FTCC). |

Mr. Scott Jenkins requested an advisory opinion regarding the application of post employment restrictions if he were to leave employment with FTCC. FTCC is part of the State Technical College system and Mr. Jenkins is a state employee. Mr. Jenkins is currently an accountant over the "accounts payable," he is neither an agency head nor a supervisor. Mr. Jenkins has recently passed the CPA exam and hopes to leave state employment to work full time for himself at his own accounting firm.

1121 B. (1) No former public employee shall, for a period of two years following termination of his public employment, render any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.
