RE:
Request that the Board waive the $600 campaign finance late fee assessed against Teresa Brumfield, a candidate for Assessor of St. Helena Parish, in the October 22, 2011 election, whose 10-G campaign finance disclosure report was filed 70 days late.
Facts:
In connection with her request for a waiver of the $600 late fee assessed for the late filing of a 10-G campaign finance report, Teresa Brumfield states that she is certain that she timely mailed her report. However, she received notice from the Campaign Finance division that her report had not been filed. Upon receipt of notice from the Campaign Finance division, she faxed filed her report. Ms. Brumfield maintains that she timely mailed her report and ask that the Board waive the assessed late fee. Ms. Brumfield is a district level candidate. This is her first campaign. She was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.18:1511.4.1 for each day until such report is filed.

Recommendations:
In accordance with the waiver guidelines, suspend all but $200 based on future compliance.
