Advisory opinion regarding whether a company owned by Jack McCain, a former councilman for the City of Natchitoches, may sell equipment and auto supplies to the City of Natchitoches.
Facts:
Jack McCain's term as a Natchitoches City Councilman ended on June 1, 2012. Mr. McCain owns 50% of the stock in McCain Auto Supply, Inc. McCain Auto Supply is a wholesale dealer in automobile parts, equipment and supplies. Mr. McCain would like to be able to sell auto supplies, parts and equipment to the City of Natchitoches.

Law:
La. R.S. 42:1121A(1) prohibits a former agency head, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, from assisting another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving his former agency or rendering any service on a contractual basis to or for such agency.

La. R.S. 42:1121D prohibits a former public servant from sharing in any compensation received by another person for assistance which such former public servant is prohibited from rendering by Section 1121.

La. R.S. 42:1102(20.1) defines "service" as the performance of work, duties, or responsibilities, or the leasing, rental, or sal of movable or immovable property.

Recommendations:
Adopt proposed advisory opinion.
