RE:
Advisory opinion regarding a former geologist for the Injection and Mining Division of the Office of Conservation (Division), Department of Natural Resources, Kaycee Garrett, engaging in consulting work for companies that may have applications with the Division.
Facts:
Kaycee Garrett has been employed as a Geologist in the Division since July of 2002. From 2002 -2004, Mr. Garrett was employed as a Geologist in the Surfacing Mining Section where he was responsible for coordinating the Mine Safety and Health Administration (MSHA) State Grant Program for the state of Louisiana. He wrote the grant package and the Division received MSHA grant funds to provide safety training to Louisiana miners. He also participated in mine inspections at lignite mines in north Louisiana to ensure that the mines were operating in compliance with State and Federal regulations.

From 2004 -2011, he was employed as a Geologist in the Underground Injection Control (UIC) Geological Section where he was responsible for reviewing all types of UIC applications. From 2011 to present, he was employed as a Geologist in the UIC Enforcement Section where he was responsible for establishing test schedules for the Conservation Enforcement Specialist (CES), review reports submitted by CES, draft Compliance Notices, Notice of Violations, and Compliance Orders, and assist with other enforcement and compliance issues. During his tenure with the Division, Mr. Garrett states that he never served in a supervisory capacity and that he never had final decision making authority.

Law:
Section 1121B of the Code prohibits a former public servant, for two years, from assisting another person, for compensation, in a transaction in which he participated during his public employment and which involves the governmental entity. Section 1121B of the Code also prohibits a public servant, for a period of two years following the termination of his public employment, from rendering any service which such former public employee rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the advisory opinion.
