Appearance in connection with a request for reconsideration of the $3,000 and $1,000 campaign finance late fees assessed against Louisiana Orthopaedic PAC, a political action committee, whose 30-P and 10-P campaign finance disclosure reports were filed 26 and 5 days late.
Facts:
In connection with her request for a waiver of the $3,000 and $1,000 late fees assessed for the late filings of a 30-P and 10-P campaign finance reports, Alesia M. Ardoin, on behalf of the committee, states that LOPAC was unfamiliar with the reporting requirements and believed that they had chosen to report "annually" rather than "monthly", not knowing that by choosing to report annually, LOPAC would then be required to file on the candidate's election cycle. She states that the Board has consistently agreed to suspend all but $1,000 of the committee's fine based on future compliance, in situations like the one presented here where a political committee was unaware that contributions made in years prior to the election triggered the committee's requirement to file reports other than the annual report which was timely filed. She further states that LOPAC has once again began filing monthly to ensure that there will be no further late filings. In addition, the Board at its April 20, 2012 meeting declined to waive the late fees.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
