Request that the Board waive the $1,000 campaign finance late fee assessed against Citizens for BREC, a political action committee whose Annual report was filed 1095 days late. |

In connection with his request for a waiver of the $1,000 late fee assessed for the late filing of an Annual campaign finance report, Ralph J. Stephens, on behalf of the committee, states that their committee on occasion raises funds if there is going to be a tax election involving taxes for BREC. The last time any funds were raised or expended was for the 2007 election. The committee has always filed a statement of organization, however, in none of the years that it has filed a statement of organization has there been any intent to raise money or spend money. Mr. Stephens further states that it was not until this year while filing an annual report and statement of organization for BREC, that it was discovered that an annual report had not been filed for the calender year of 2009. He maintains that failure to file the annual report was in no way an attempt to hide or mislead the public with regard to any activity of Citizens for BREC. Had the statement of organization not been filed, no annual report would have been needed.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
