RE:
Request that the Board waive the $3,000 campaign finance late fee assessed against Adams and Reese, a political action committee, whose Monthly campaign finance report was filed 76 days late.
Facts:
In connection with his request for a waiver of the $3,000 late fee assessed for the late filing of a Monthly report, William C. Potter, on behalf of the committee states that his staff is diligent each month in getting their cash transactions to him to include in their electronic filing process. In addition to the monthly report for Adams and Reese, his firm prepares three other monthly disclosure reports for other political action committees. Mr. Potter maintains that his assistant electronically filed reports for two other political committees on March 10, 2012. Mr. Potter states that he has no explanation as to why the report for Adams and Reese was not timely filed. He believes that it may have been a mistake, error, or a systemic problem.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
