Request that the Board waive the $400 campaign finance late fee assessed against Vanessa Guidry-Whipple, a candidate for 1st Circuit Court of Appeal, 1st District, Div. D, in the November 6, 2012 election, whose 180-P campaign finance disclosure report was filed 4 days late.
Facts:
In connection with her request for a waiver of the $400 late fee assessed for the late filing of a 180-P campaign finance report, Vanessa Guidry-Whipple states that her report preparer, Thomas J. Lanaux contacted the Campaign Finance division and received instructions from the staff that the only report due was an Annual report. However, on Monday, May 14, 2012, Mr. Lanaux was advised by staff that previous instructions were incorrect and that even if campaign funds had not been raised, deposited or expended, the 180-P report was still due. She maintains that staff from the Campaign Finance division was very apologetic and assisted Mr. Lanaux as he electronically submitted the report. Ms. Guidry is a major level candidate. This is her fourth campaign.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
