Advisory opinion request regarding whether the end of a person's public service is the date of his resignation or the date his successor is appointed in connection with such resigning member's filing requirements under Tier 2.1.
Facts:
The Louisiana Department of Culture, Recreation, and Tourism states that there are numerous boards and commissions under its purview. An issue has arisen regarding the resignation of a member on the Louisiana State Museum Board. There is a statute in general which states that a member continues to serve until his successor is appointed and takes his office R.S. 42:2.



David Platter resigned prior to December 2010. His replacement was not appointed until Janaury 2011. Out of abundance of caution, Mr. Platter filed both his 2010 and 2011 Tier 2.1 annual pfds. The issue is whether he was required to file both reports since Tier 2.1 requires a board member to file each year during which he holds office and the year following the termination of holding such office.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

Recommendations:
Decline to render as the matter involves past conduct.
