Consideration of a disqualification plan involving the promotion and supervision of Bridgett Bartlett, assistant principal with the Winn Parish School System, while her father-in-law, Steve Bartlett, serves as the Superintendent of the Winn Parish School System.
Facts:
Steve Bartlett has been employed with the Winn Parish School Board since 1974. Mr. Bartlett was promoted to Superintendent in July 2000.

Bridgett Bartlett was first employed with the Winn Parish School Board as a certified teacher in February 1999. On June 30, 2003, Ms. Bartlett married Mr. Bartlett's son. On August 1, 2008, Ms. Bartlett was promoted to assistant principal.

Ms. Bartlett was recently one of three applicants for principal at Atlanta High School. Mr. Bartlett recused himself from the process and a committee of three persons interviewed the applicants. The committee recommended to the central office supervisor responsible for personnel that Ms. Bartlett be promoted to the principal position.

Mr. Bartlett and Ms. Bartlett are submitting a disqualification plan disqualifying Mr. Bartlett from any supervisory duties and/or authority regarding the employment of Ms. Bartlett. Al Simmons, central office supervisor will have all supervisory duties and/or authority as to matters affecting Ms. Bartlett's employment, including observations, evaluations, salary, and assignments.

Law:
La. R.S. 42:1119B(2)(a)(i) permits the school board to employ an immediate family member of a school board member, provided the family member is certified to teach and teaching in a classroom.

La. R.S. 42:1119C(2) provides a limited exception to the general nepotism prohibition and allows the continued employment and normal promotional advancement of a public employee when a member of the public employee's immediate family becomes the agency head of the public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.

La. R.S. 42:1112C allows a disqualification plan to be developed in accordance with rules adopted by the Board to remove a public servant from participating in transactions that would otherwise present violations of Section 1112 of the Code.

Recommendations:
Accept the disqualification plan.
