RE:
Advisory opinion request from Daniel Duhon regarding whether he may be hired as a compensated fireman for the Town of New Llano Fire Department while his uncle is a chief at the same fire department.
Facts:
Mr. Duhon has applied for a compensated position with the New Llano Fire Department. His uncle is the assistant chief within the same department.
Law:
Section 1102(13) of the Code defines "immediate family member" as it relates to a public servant as his children, the spouses of his children, his brothers and his sisters spouses, his parents, his spouse, and the parents of his spouse.

Section 1119 of the Code prohibits the immediate family member of an agency head from being employed within his agency.
Recommendations:
Adopt the proposed advisory opinion.
