Advisory opinion regarding post employment restrictions on George Wallace an employee of the Louisiana Department of Transportation and Development.
Facts:
Mr. Wallace has been a Right of Way Review Appraiser for the last 17 years with the Louisiana Department of Transportation and Development. Mr. Wallace is not an agency head. His current position requires review of appraisals. The contract work he is seeking is to be on the list of approved appraisers for the Department and in that capacity he would draft the appraisal. If he was selected from the pool of approved appraisers to provide an appraisal it would not be on any files which he has reviewed. All projects would be new projects.

Law:
1121 B. (1) General rule for other public employees. No former public employee shall, for a period of two years following termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to for, or on behalf of the agency with which he was formerly employed.



Recommendations:
Adopt the proposed advisory opinion.
