Request that the Board waive the $9,760 in campaign finance late fees assessed against Jerry Rosenberg, a candidate in the future election, whose six (6) Annual campaign finance disclosure reports were filed 1,967, 1,612, 1,234, 869, 506, and 141 days late.
Facts:
In connection with her request for waiver of the $9,760 in late fees assessed for the late filings of six (6) Annual campaign finance reports, Yvette Soniat, on behalf of Jerry Rosenberg, states that she was hired by Mr. Rosenberg to prepare his 2007 federal and state income tax returns. At the time of her employment, Mr. Rosenberg did not realize that his former accounting firm had not filed the 2006 and 2007 campaign reports. She states that her primary focus was on the timely filing of his income tax returns and she was not aware of the campaign reports filing requirements or deadlines. She maintains that it was not until Mr. Rosenberg's office manager mentioned that the campaign account would be closed as soon as the last funds were distributed, that it occurred to her that the campaign reports had not been prepared. On June 19, 2012, she received appropriate documentation and the reports were submitted electronically on July 5, 2012. Ms. Soniat maintains that Mr. Rosenberg is not an active candidate for political office and has not received campaign contributions for several years. As of December 31, 2011, the account had a balance of $2,120, and each year Mr. Rosenberg makes several small contributions to political campaigns or other charitable contributions from the account.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
