RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Victor W. Rogers, a candidate for Arcadia Chief of Police, in the October 2, 2010 election, whose Supplemental campaign finance disclosure report was filed 27 days late.
Facts:
In connection with his request for a waiver of the $1,000 late fee assessed for the late filing of a Supplemental campaign finance report, Victor W. Rogers, states that he had no other campaign funds to report, and had no other opponents to run against him in the general election. He further states that he received notice that he needed to correct a candidate's report that he previously filed. He maintains that he initially sent in a financial report in October of 2010 for the primary election, and it was his understanding that since he did not have any other campaign funds to report or no other opponents to run against him, he was not required to file an additional report. Mr. Rogers is an any other level candidate. This is his sixth campaign. He was a successful candidate.

A 10-P and 10-G reports filed 37 and 4 days late, in connection with the October 5, 2002 election, and a 10-P, EDE-P, and 10-G reports filed 1, 2, and 8 days late, in connection with the October 2, 2010 election. The late fees assessed for the late filings of the reports have been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

La. R. S. 18:1495.5D(1) of the CFDA provides that if the final report of a candidate for an election shows a deficit or a surplus, the candidate shall file a supplemental report with the supervisory committee of all expenditures, loans, and contributions received. Such reports are filed annually no later than February 15 and shall be complete through the preceding December thirty-first. Such report shall be filed until a report is filed which shows no deficit and until any surplus campaign funds have been disposed.

La. R.S. 1495.4D(3)(c) provides that any candidate who is serving in any elected public office during the reporting period for any supplemental report required shall be considered an elected official.
