RE:
Request that the Board waive the $1,250 and reassessed $1,100 campaign finance late fees assessed against Louisiana Home Builders Association PAC, a political action committee, whose 10-G campaign finance report was filed 411 days late.
Facts:
In connection with her request for a waiver of the $1,250 late fee assessed for the late filing of a 10-G report, Jeannie A. Dodd, on behalf of the committee states that the committee issued a campaign contribution check to Rep. Jonathan Perry on February 1, 2010 for the amount of $1,000. Ms. Dodd states that Rep. Perry never received the check and the check has not cleared the bank. Ms. Dodd further states that a check for $250 was issued to Rep. Perry on February 4, 2010. At that time Rep. Perry had not announced his candidacy for the Louisiana Senate election held on February 19, 2011. Ms. Dodd maintains that both checks were included in the committee's Annual report filed on February 15, 2011.

A 10-G report filed 1 day late, in connection with the October 20, 2007 election, and 180-P and 90-P reports each filed 8 days late, in connection with the October 22, 2011 election. The Board Docket No. 2011-1116, agreed to suspend all but $500 of the $1,600 assessed for the late filing of the 180-P report filed 8 days late conditioned upon future compliance. The $1,100 late fee is being reassessed as a result of recent late filing of the 10-G report.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
