Advisory opinion regarding whether ActRight Fund is required to register as a political action committee with the State of Louisiana.
Facts:
ActRight Fund is not a registered PAC under federal law or any other state. It is an unincorporated fund registered with the IRS and files IRS reports of contributions and expenditures. The ActRight Fund hosts a website that collects contributions for Federal candidates. The contributors choose what educational and issue advocacy organization they want to support. Separate bank accounts are issued for each entity and contributions to candidates are processed separately from donations to other causes. ActRight offers a separate service agreement to candidates whereby the candidates agree that ActRight will collect contributions for candidates and their committees for a reasonable service fee. Individuals contribute to the campaign of their choice by using their credit card on ActRight's website. ActRight exercises no discretion in determining the recipient committee and no control over the funds. All contributions for the candidates are distributed to the candidate's committee along with the source of the contribution.
Law:
Section 1483(14)(a) of the Campaign Finance Disclosure Act provides that a political committee shall include two or more persons other than a husband and spouse, and any corporation which supports or opposes one or more candidates, propositions, recalls, of a public officer, or political parties, and which accepts contributions or direct payments for personal services related to an election or a campaign in the name of the committee in an aggregate amount in excess of $500 or makes expenditures in an amount in excess of $500 in support or opposition of a candidate.

Recommendations:
Adopt the advisory opinion.
