Advisory opinion regarding whether there will be a violation of the Code of Ethics where employees of the Department of Children and Family Services (DCFS) serve as members of the board of directors for an entity that contracts with DCFS.
Facts:
Charlie Dirks, Executive Counsel for DCFS states that DCFS has been mandated by the Louisiana Supreme Court to work with youth and families with the Louisiana Child Welfare system. DCFS intends to create a 501C(3) non-profit corporation for the purpose of providing specialized training to persons who work within the juvenile system. The entity will be administered by a board of directors and seek public funds through DCFS from the federal government. If awarded funding the entity will be required to enter into a contract with DCFS for the purpose of directing funds to the entity. If the funds are granted, the Secretary of DCFS and two other employees of the department will serve as members of the board of directors for the company.
Law:
Section 1111C(2)(d) of the Code prohibits a public servant from accepting anything of economic value from a person who has a business contractual or financial relationship with the agency of the public servant.
Recommendations:
Adopt the proposed advisory opinion.
