Advisory opinion request from Lecompte Mayor Gregory Clark regarding the promotion of an employee to the position of police chief.
Facts:
Ms. Tamara Williams, is an elected Alderman and daughter of Mr. Williams. Mr. Williams was hired by the police department a year and a half prior to his daughter becoming Alderman. Mr. Williams is currently serving as the Assistant Chief in the Lecompte Police Department. The Mayor of Lecompte has advertised the position of Police Chief. Mr. Williams has applied along with several others. The Mayor according to the Louisiana Handbook for Municipal Officials will select one applicant and submit that applicant's name to the Board of Alderman to be confirmed as Chief of Police for the Town of Lecompte.
Law:
La. R.S. 42:1102(11) "Governing authority" means the body which exercises legislative functions of a political subdivision.
La. R.S. 42:1119B(1) No member of the immediate family of a member of a governing authority or the chief executive of a governmental entity shall be employed by the governmental entity.

La. R.S. 42:1119C.(2) The provisions of this Chapter shall not prohibit the continues employment of Any public employee nor shall it be construed to hinder or alter , or in any way affect normal promotional advancements for such public employees where a member of the public employees' immediate family becomes an agency head of such public employees agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employees immediate family becoming the agency head.
