RE:
Request that the Board waive the $600 campaign finance late fee assessed against M. A. DeJohn, a candidate for Coroner of East Feliciana Parish, in the October 22, 2011 election, whose 30-P campaign finance disclosure report was filed 302 days late.
Facts:
In connection with his request for a waiver of the $600 late fee assessed for the late filing of a 30-P campaign finance report, M. A. DeJohn states that his address was incorrectly entered in the system, and as such, correspondence sent to his address was returned to our office. Mr. DeJohn is a district level candidate. This is his seventh campaign. He was a successful candidate.

After a review of staff's records, it was determined that the notice of delinquency sent to Mr. DeJohn on September 28, 2011was sent to an incorrect address (see attached documentation).

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $200 based on future compliance.
