Appearance in connection with a request that the Board waive the $1,400 campaign finance late fee assessed against Delta PAC, a political action committee, whose 90-P campaign finance disclosure report was filed 7 days late.
Facts:
In connection with his request for a waiver of the $1,400 late fee assessed for the late filing of a 90-P campaign finance report, Robert L. Rieger, Jr., counsel on behalf of the committee, states that the committee believes that the question of a report being required to file was triggered by a contribution made to Rep. Eric Ponti in February, 2012. The contribution was made for the intent of Rep. Ponti's anticipated race for re-election as a State Representative, District 69. Mr. Rieger further states that the committee was unaware Rep. Ponti qualified as a candidate to seek the seat of Public Service Commissioner, Dist. 2 in the November 2012 election. When Delta PAC learned that Rep. Ponti qualified for the office, the committee inquired as to whether or not Mr. Ponti was going to utilize contributions to his Representative account for the November 2012 election. Immediately after being advised in the affirmative, the committee filed a 90-P report. Mr. Rieger maintains that upon the committee being advised of the transfer of its contribution, it immediately filed a 90-P report. The filing was perfected the very day Mr. Ponti qualified for the Public Service Commissioner, Dist. 2 seat, a Major level office. Mr. Reiger further states that the candidate's plans did not become public until the qualification period, which closed on August 17, 2012 a week after the deadline for 90-P reports.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
