RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Tony Guirlando, a candidate for Ouachita Parish School Board, in the October 2, 2010 election, whose 10-G campaign finance disclosure report was filed 158 days late.
Facts:
In connection with his request for a waiver of the $1,000 late fee assessed for the late filing of a 10-G campaign finance report, Tony Guirlando states that he mailed his report in October of 2010. However, he was contacted by staff on March 21, 2011 and informed that his report had not been received. On March 21, 2011 he re-faxed the same report that he previously mailed in October. Mr. Guirlando states that he was again contacted by staff on April 1, 2011 and was told that his report had not been received. Mr. Guirlando maintains that for a third time, he sent his report via fax and email on April 1, 2011. In all three instances, he attempted in good faith to file the proper paperwork, and therefore ask that the late fee be waived. Mr. Guirlando is an any other level candidate. This is his first campaign. He was an unsuccessful candidate.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
