Advisory opinion regarding whether Allen Brown, an officer with the St. James Parish Sheriff's office, may accept free rent from a newly constructed subdivision in exchange for private security services.
Facts:
Allen Brown is employed as a full-time deputy sheriff with the St. James Parish Sheriff's office. Latter & Blum owns a newly constructed subdivision consisting of two and three bedroom homes that will be rented to the general public. The subdivision is located in St. James Parish. Latter & Blum is seeking the services of deputy sheriff Allen Brown to provide the presence of a marked police unit on property; completing a "lights out report" bi-monthly; and checking in with the leasing officer twice a week in exchange for free monthly rent.

Law:
La. R.S. 42:1111C(1)(a) prohibits a public servant from receiving any thing of economic value for any service, the subject matter of which is devoted substantially to the responsibilities, programs, or operations of the agency of the public servant and in which the public servant has participated.

La. R.S. 42:1123(15) provides an exception to the provisions of the Ethics Code to permit duly commissioned law enforcement officers to provide private security services, which are approved by and in accordance with a policy of their public employer. The policy of the public law enforcement body must be published in the official journal of the parish and provide for the use of public vehicles for private employment.

Recommendations:
Adopt proposed advisory opinion.
