Advisory opinion request from Corliss Green, a contract worker with the Governor's Office of Elderly Affairs regarding the effects of post employment restrictions as well as whether or not she is required to take ethics training.
Facts:
Ms. Corlis Green was a contract employee of Governors Office on Elderly Affairs (GOEA). Her contract was to provide assistance to the Audit Section of the GOEA from April 24,2012 to June 30, 2012. The services she rendered to the GOEA were to review budget audits. Ms. Green has requested an opinion on whether she is restricted by the Ethics Code from seeking future contractual employment with The Area Agency on Aging/Council on Aging (AAA/COA). She does not anticipate rendering the same services to the AAA/COA. She did not review any AAA/COA funding or service request made to GOEA while in the employ of GOEA. The AAA/COA is a non-profit organization which was chartered by the Governor's Office in May 1974 and is primarily state funded.

Law:
La. R.S. 42:1121B.(1) General rule for public employees. No former public employee, shall for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction , or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment...

La. R.S. 42: 1102 (16) defines a person as an individual or legal entity other than a governmental agency.

La. R.S. 42:1170 A(3) commencing on January 1 2012, each public servant ... shall receive a minimum of one hour of education and training on the Code of Governmental Ethics during each year of his public employment.

Recommendations:
Adopt the proposed advisory opinion.
