RE:
Request for an advisory opinion from Stacey Ashy of the Lafayette Parish School System, regarding whether it is the responsibility of the employees or the employer to ensure that the annual ethics training requirement is met once the employees have been notified of the annual requirement, and whose responsibility it is to keep the related supporting documentation.
Law:
La. R.S. 42:1170A(3) provides an annual training requirement for "public servants" and states as follows:


Commencing on January 1, 2012 each public servant who was not required to complete education and training pursuant to Paragraph (1) or (2) of this Subsection shall receive a minimum of one hour of education and training on the Code of Governmental Ethics during each year of his public employment or term of office, as the case may be.

Section 1170E(1) states the Board of Ethics shall keep records of the compliance with the requirements of this Section by each public servant and by state agencies.

According to Section 1161A, an agency head is mandated to file confidential reports with the Ethics Board on matters that come to such agency head's attention which he or she believes may constitute a violation of the Ethics Code.

Recommendations:
Adopt proposed advisory opinion.
