Advisory opinion request regarding whether St. Tammany Fire District #12 can do training on trees donated by their attorney, Robert Barnett.
Facts:
The Louisiana Board of Ethics, at its November 16th, 2012 meeting, considered your request for an advisory opinion regarding the use of trees on private property to train your firefighters on how to handle a chainsaw on downed trees. You have stated that after Hurricane Isaac it was apparent that your employees were not adequately prepared to cut and remove damaged trees. You have stated that you have an opportunity to train on damaged trees downed on property adjacent to the fire house owned by your attorney Mr. Robert Barnett. You have found that it is not enough to train the firefighters on trees that have been pulled into the Firehouse parking lot. Mr. Barnett is willing to donate the trees to the firehouse and you have made arrangements for you insurance to cover any possible injuries incurred during the training. Further you have stated that you will not remove the trees from the property after the training is over.

Law:
La. R.S. 42:1113 No public servant shall enter into a transaction that is under the supervision or jurisdiction of his agency.

La. R.S. 42:1123(30) a public servant is not precluded from donating services, movable property, or funds to his agency.

Recommendations:
Adopt the proposed advisory opinion.
