RE:
An advisory opinion request from the Fire Chief of Rapides Parish Fire District No. 2 regarding whether a fire district can hire immediate family members of district chiefs employed within the fire district.
Facts:
Rapides Parish Fire District No. 2 wishes to hire the sons of two district chiefs who are employed within the fire district. The job duties of district chiefs consists of supervising districts which consist of 2 or 3 fire stations and the employees assigned to these districts. The fire district has stated that the district chiefs would have no direct authority over their sons because of assignments to different districts and different work shifts.
Law:
Section 1119(A) of the Code of Governmental Ethics prohibits an immediate family member of an agency head from being employed in his agency.
Section 1102(13) of the Code of Governmental Ethics defines "immediate family", as the term relates to a public servant, as his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.

Recommendations:
Adopt the proposed advisory opinion.
