Request that the Board waive the $440 and $320 campaign finance late fees assessed against C. O. Simpkins, a candidate for Coroner of Catahoula Parish, in the October 22, 2011 election, whose Special and EDE-P campaign finance disclosure reports were filed 11 and 8 days late.
Facts:

In connection with his request for a waiver of the $440 and $320 late fees assessed for the late filings of Special and EDE-P campaign finance reports, George Lewis, III, on behalf of the candidate states that the reports were submitted in a timely manner, however, after speaking with Campaign Finance staff, he learned that the reports were not timely filed. Mr. Lewis maintains that the Special report was timely mailed and faxed on October 4, 2010 and the EDE-P report was timely faxed on October 20, 2012. However, campaign finance records show that the Special report was due September 21, 2010 and filed on October 2, 2010, and was 11 days late when it was received. The EDE-P report was due October 12, 2010 and faxed filed on October 20, 2010 and 8 days late when it was received.

In addition, the Ethics IT division researched its records to determine if the reports were received on or before the due dates of September 21, 2010 and October 12, 2010. The attached fax log shows several dates that reports were received from Mr. Simpkins. On the dates closest to when the reports were due, the log shows that on September 22, 2010, a 10-P report was received, and on October 11, 2010, an amended 30-P report was received (see attached documentation). There are no other dates from the log that shows the reports being faxed on or before their due dates.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Suspend all but $200 on the Special Report and decline to waive the EDE-P report.
