Advisory opinion regarding whether the former Director of Engineering for St. Tammany Parish, Johnny Bordelon, may accept employment with a engineering consulting firm that does business with St. Tammany Parish.
Facts:
Mr. Bordelon states that he recently resigned from his position as Director of Engineering for St. Tammany Parish. He states that he held the Director of Engineering position for 6 months, following 4 years in the private sector as a consultant. His responsibilities as Director included oversight of the Department of Engineering's consultant review process and offering recommendations to the Parish President and Parish Council on firms to perform engineering work for the Parish. The final selection of these firms and the awarding of contracts were made by the Parish President and the Department of Administration.



Mr. Bordelon's future employment would be with a firm that performs consulting, design, and construction work in the fields of Planning, Engineering, Surveying, and Construction management. He would be employed as a staff engineer. He has no ownership interest in the company nor does he serve in a director position. The firm is headquartered in Slidell, Louisiana and is presently providing engineering services to St. Tammany Parish, and has done so for many years. Mr. Boredelon states that in the new position he will separate himself and avoid any representation of the firm in business matters with the St. Tammany Parish. He states that he would not directly or indirectly assist the firm in any matters relating to the St. Tammany Parish government for a period of two years.

Law:
Section 1121A(1) of the Code prohibits a former agency head, for a period of two years following the termination of his public service, from assisting another person for compensation in a transaction, or in an appearance in connection with a transaction, involving his former agency or render any service on a contractual basis to or for such agency.
Recommendations:
Adopt the proposed advisory opinion.
