RE:
Request for an advisory opinion as to whether a water station may be located on the property of Representative James K. Armes III while he serves as a Louisiana State Representative.
Facts:
Rep. Armes owns property on Highway 467 which has been funded for construction of sewer system and water improvements through HB 2.

He has been approached by the project engineer about allowing a water station to be located on his property. His property was chosen because it was the low point of the routing and located directly across from the wastewater line going into the wastewater plant. He has been informed that allowing the water station on his property would save the City of Leesville approximately $100,000. If the water station is constructed on his property, he and the City of Leesville will be parties to the transaction. If his property is selected for the location of the water station, Rep. Armes will be compensated, however, he are not sure of the exact amount. The grant requires the certified appraisal of all properties acquired and offers are made based upon appraisals. The appraisals will not be complete for another forty five days.

Law:
Section 1113D prohibits a legislator from entering into a contract with state government.



Recommendations:
Adopt proposed advisory opinion.
