Request for an advisory opinion regarding the propriety of the wife of Roscoe W. Lewis, Sr. serving as an Executive Director for Public Housing Authority in the district where Mr. Lewis serves as Justice of the Peace for the 8th Justice Court. |

As Director of the Housing Authority Ms. Lewis will file eviction proceedings in her husband's court as well as be involved in other matters in which a Justice of the Peace would provide advice. When doing so she would not come before Mr. Lewis, but a member of her staff would.

Whether the wife of a Justice of the Peace may serve as the Director of the Housing Authority in the jurisdiction in which her husband presides.

Section 1113 of the Code prohibits an immediate family member of a public servant from entering into a contract, subcontract, or other transaction under the supervision or jurisdiction of the public servant's agency.
|
|
Because Ms. Lewis is not entering into transaction with the agency of her spouse, no violation of 1113 is present.
|
