Advisory opinion request from the president of Sterlington Elementary School Parent Teacher Organization (PTO) regarding his selling grass to the PTO below cost.
Facts:
The president of the Parent Teacher Organization (PTO) Mr. Cole Sims has requested an advisory opinion regarding whether the PTO of Sterlington Elementary may use a portion of the funds they have raised to make improvements to the school playground. He stated that he would like to install sod to improve the conditions. He is part owner of a local Sod farm Wilderness Turf Farms, LLC., and Wilderness has offered to provide the Sod below cost to the school.

Law:
La. R.S. 42:1102 (19) "public servant" means a public employee or an elected official.

La. R.S. 42:1102(2)(a)(i) allows for certain non-compensated members of Board or commissions to be considered "public servants" if those board member are appointed by the public official.

La. R.S. 42:1102(15) "participate" means to take part in or share the responsibility for the action of the governemetal entity.

Recommendations:
Adopt the proposed advisory opinion.
