Appearance in connection with a request for reconsideration of a $420 campaign finance late fee assessed against Allen Guillory, a candidate for State Representative, 40th District in the August 1, 2009 election, whose Supplemental campaign finance disclosure report was filed 7 days late.
Facts:
In connection with his request for reconsideration of a waiver of the $420 late fee assessed for the late filing of a Supplemental campaign finance report, Allen Guillory states that he did not receive a letter letting him know it was time to file a report. He further states that he only received notice stating that the Supplemental report was past due, and as soon as he received the notice, he immediately filed his report online. Mr. Guillory is a district level candidate. This is his fifth election.

In addition, a reminder letter dated January 12, 2012 was sent to Mr. Guillory informing him of the requirement to electronically file a Supplemental report for the April 1, 2009 election(see attached documentation) Also, on February 22, 2012 candidate was contacted by campaign finance staff concerning reporting information on a report he filed. It was at that time, that the candidate was notified that he had not electronically filed his Supplemental report for the April 1, 2009 election.

A Supplemental campaign finance report filed 7 days late, in connection with the October 4, 2003 election. The late fee assessed for the late filing of the report has been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.
