Reconsideration of a request that the Board waive the $800 and $900 late fees assessed against John F. Schwegmann, a candidate for Public Service Commissioner, Dis. 3, Jefferson Parish in the October 2, 2010 election, whose 30-P and EDE-P campaign finance disclosure reports were filed 8 and 9 days late.
Facts:
In connection with his request for a reconsideration of a waiver of the $800 and $900 late fees assessed for the late filings of his 30-P and EDE-P campaign finance reports, John F. Schwegmann states that for several years his health situation has declined to the point that he was literally on his deathbed in Ochsner Hospital. His situation was a great distraction and he was gradually becoming more and more anemic with great physical pain. He was eventually admitted to Ochsner and stayed for a week undergoing tests. He received more than a month of iron infusions. Mr. Schwegmann maintains that it has always been extremely important to him to follow the rules and regulation of the Ethics Administration, but there were extraneous circumstances that caused him to be late with his reports. Mr. Schwegmann has provided medical documentation from his doctor to support his claim. The letter states that Mr. Schwegmann was admitted to Oschner from May 31-June 3, 2012 and is still under medical care receiving outpatient treatment. The letter was dated October 24, 2012. The documentation is attached for the Board's consideration. Mr. Schwegmann is a major level candidate. This is his eighth campaign. He was an unsuccessful candidate.
