Reconsideration of a request that the Board waive the $9,760 in campaign finance late fees assessed against Jerry Rosenberg, a candidate in the future election, whose six (6) Annual campaign finance disclosure reports were filed 1,967, 1,612, 1,234, 869, 506, and 141 days late.
Facts:
In connection with her request for a reconsideration of a waiver of the $9,760 in late fees assessed for the late filings of six (6) Annual campaign finance reports, Jonelle Couch, on behalf of Jerry Rosenberg states that she has been Mr. Rosenberg's office manager for 17 years. In late 2007, she tragically lost her 17 year old son. At that point, she was unable to perform her job duties and was diagnosed with PTSS. It took two years, before she was able to return to work. Ms. Couch maintains that their office changed accounting firms and until recently the firm was unaware that Mr. Rosenberg had a campaign fund. Ms. Couch asks that the Board reconsider waiving the late fees. Also, Ms. Couch has provided documentation supporting her claim regarding her son's passing, and it is attached.

Two Annual reports filed Specials filed 891 and 118 days late. The Annual reports were due February 17, 2004 and February 15, 2006. The late fees assessed for the late filings of the reports were waived.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.

Recommendations:
Rescind the late fees for the annual reports that were required in 2007, 2008, and 2009. Decline to waive the late fee for annual reports due in 2010, 2011, and 2012.
