RE:
Request that the Board waive the $800 late fee assessed against Louisiana CPA PAC, a political action committee, whose 90-P campaign finance disclosure report was filed 14 days late.
Facts:
In connection with his request for a waiver of the $800 late fee assessed for the late filing of a 90-P campaign finance report, Ronald A. Gitz, II, Treasurer on behalf of the committee, states that the committee acknowledges that errors were made in compliance with the period reports for 2012, but he believes that the mistakes were inadvertent and not intentional. Mr. Gitz states that when the committee contributed to the Erich Ponti campaign on January 11, 2012, they contributed based on the fact that Mr. Ponti was running for his Representative position. He further states that the committee would not have contributed in January of 2012 if it had known Mr. Ponti was going to run for Public Service Commissioner in the November 2012 election. The committee has applied for the monthly electronic filing and will file monthly reports going foward.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
