Advisory opinion regarding BookSouth purchasing new and unused textbooks from college professors and universities.
Facts:
BookSouth is a textbook wholesaler that collects unused instructor and annotated textbooks sent by publishers at no cost to faculty members in hopes the textbooks will be used in their curriculums. BookSouth would purchase these textbooks from the professors and return them into circulation. Being informed that purchasing the textbooks from the professors directly may pose issues under the Code of Ethics, BookSouth is now suggesting that it enter into an agreement directly with the public university and in exchange for the textbooks, make a donation to the university.

Law:
La. R.S. 42:1111A prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.

Recommendations:
Adopt proposed advisory opinion.
