Appearance in connection with a reconsideration of waiver request submitted by James Donelon regarding a $17,500 late fee assessed for filing his 2011 Tier 1 annual pfd 36 days late.
Facts:
James Donelon is the Commissioner of Insurance. The notice of delinquency was received on June 8, 2012 making the report due on or before June 28, 2012. Mr. Donelon states that he went into the hospital on July 9, 2012 for major surgery and did not return to the office until August 3, 2012, when the report was filed.

Law:
La. R.S. 42:1124 requires the secretary of the department of insurance to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than fourteen (14) business days after receipt of the notice of delinquency.

La. R.S. 18:1505.2I(4) provides that no candidate, political committee or person required to file reports under this Chapter, nor any other person shall use a contribution, loan, or transfer of funds to pay a fine, fee, or penalty imposed pursuant to the provisions of the Code of Governmental Ethics.
