RE:
Request that the Board waive the $2,000 campaign finance late fee assessed against Lindora Baker, a candidate for State Representative, 3rd District, in the October 20, 2007 election, whose 2011 Supplemental campaign finance disclosure report was filed 240 days late.
Facts:
In connection with her request for a waiver of the $2,000 late fee assessed for the late filing of a Supplemental campaign finance report, Lindora Baker states that she did not understand that she was required to electronically file her report in connection with a loan she obtained during her campaign for State Representative in 2007. She maintains that she thought that she only needed to file a Supplemental report only one time; not every year. It was purely a misunderstanding on her part.

A 10-G report filed 2 days late, in connection with the October 4, 2003 election. A 30-P, EDE-P, and Supplemental campaign finance reports filed 19, 73, and 368 days late, in connection with the October 20, 2007 election. The late fees assessed for those late filings of the reports have been paid. The candidate currently has a late fee and order for $4,000 regarding a Supplemental report due February 17, 2010, and a Supplemental report due February 15, 2011 and filed 205 days late. The $1,000 late fee assessed for the late filing of the report is outstanding. The candidate has made arrangements to pay $500 per month until the $5,000 in late fees is paid in full.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.
