Request that the Board waive the $600 campaign finance late fee assessed against Celia A. Langlinais, a candidate for City of Kaplan Court Marshal, in the November 6, 2012 election, whose 30-P campaign finance disclosure report was filed 13 days late.
Facts:
In connection with her request for a waiver of the $600 late fee assessed for the late filing of a 30-P campaign finance report, Celia A. Langlinais states that she timely filed her report, however, it was filed on paper form. She further states that she was unaware of the requirement to electronically file her report. It was not until she received notice from the Campaign Finance division, that she became aware of the requirement and she immediately made arrangements to file her report electronically. Ms. Langlinais maintains that when she ran three years ago, she filed her reports through the mail, and so she thought that it was done the same way for the November election. If she had known that the law had changed, she would have electronically filed her report. In addition, candidates participating in the November election were notified of their requirement to electronically file their reports. This information was placed within the qualifying packet which was given to the candidate by the Clerk's office at the time of qualifying. Ms. Langlinais is a district level candidate. This is her second campaign. She was an unsuccessful candidate.

A 30-P and 10-G campaign finance disclosure reports filed 4 and 14 days late, in connection with the October 4, 2008 election. The late fees assessed for the late filings of the reports have been paid. An EDE-P campaign finance disclosure report filed 1 day late in connection with the November 6, 2012 election. The late fee assessed for the late filing of the report has not been paid.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed. 18:1485C. Each candidate for a major or district office and each principal campaign committee of a candidate for a major or district office shall electronically file reports of contributions and expenditures with the supervisory committee. Effective January 1, 2012, Act 25 of the 2008 2nd Extraordinary Session requires Major and District office level candidates to electronically file campaign finance disclosure reports. A report is considered not filed until it is filed electronically.
