RE:
Request that the Board waive the $1,000 campaign finance late fee assessed against Marcus Crochet, a candidate for Chief of Police for the Town of Welsh, in the November 6, 2012 election, whose 30-P campaign finance disclosure report was filed 34 days late.
Facts:
In connection with his request for a waiver of the $1,000 late fee assessed for the late filings of the 30-P campaign finance report, Marcus Crochet states that he is a first time candidate who misunderstood the filing requirements for his report. He believed that the first report began from the date of the first contribution/expenditure. Thus he completed all contributions/expenditures on the 10-P report. Mr. Crochet states that he did receive notice from the Campaign Finance division regarding the 30-P report, but again, believed that he was in compliance. It was not until his wife spoke with a compliance officer, that he was made aware that the original report that he filed should be separated into a 30-P and 10-P report. Mr. Crochet maintains that as a newcomer in the campaign process, he did what he thought was correct. He did not intentionally fail to file the report, he just did not understand the instructions. As soon as he realized that he made a mistake, he quickly worked to resolve the problem and sent in all necessary forms. Mr. Crochet states that his campaign was a small one, and his income was significantly reduced during the campaign season. It would be a financial hardship for him and his family to have to pay the late fee, and ask that the Board either reduce or waive the late fee. Mr. Crochet is an any other level candidate. He was a successful candidate.
