RE:
Request that the Board waive the $400 campaign finance late fee assessed against Roland J. Boudreaux, a candidate for Mayor of the City of Rayne, in the November 6, 2012 election, whose EDE-P campaign finance disclosure report was filed 10 days late.
Facts:
In connection with his request for a waiver of the $400 late fee assessed for the late filing of an EDE-P campaign finance report, Roland J. Boudreaux, states that his wife did not file an election day expenditure report, because she believed that if there were no expenditures to report, there was no need to file a report. It was not until he received notice from the Campaign Finance division, that he became aware of the requirement to file an expenditure report. He maintains that his wife spoke with someone in the Leaders program department a few days after the election and was told that if he had nothing to file, then a report was not needed. Mr. Boudreaux is an any other level candidate. This is his sixth campaign. He was a successful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
