RE:
Request that the Board waive the $400 campaign finance late fee assessed against Jerry Trabona, a candidate for Chief of Police for the Town of Amite, in the November 6, 2012 election, whose EDE-P campaign finance disclosure report was filed 10 days late.
Facts:
In connection with his request for a waiver of the $400 late fee assessed for the late filing of an EDE-P campaign finance report, Jerry Trabona, states that prior to Election Day, he contacted the Louisiana Board of Ethics and spoke to a representative in reference to filing an election day report. He maintains that he was advised that he was not required to file an election day expense report, if he did not have any transactions or expenditures. He states that he did not have any transactions or expenditures to report, therefore, he did not file a report. He further states that after the election, he received notice from the Campaign Finance division and upon receipt of the notice, he filed a report. Mr. Trabona is an any other level candidate. This is his fourth campaign. He was a successful candidate.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
